A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks legal authority.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case originates in a erroneous deportation to El Salvador in March, which the government later admitted was an error. After his repatriation to the United States to face alien smuggling allegations, he was held in immigration custody.

In her decision, the court pointed out that the authorities does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
